The company administering the website www.hotel-eshop.ro, hereinafter referred to as MOD-ELLE COMPANY, is SC MOD-ELLE COMPANY SRL. Use of this website implies acceptance of the terms and conditions below. Please read these terms and conditions of sale carefully. MOD-ELLE COMPANY reserves the right to modify these provisions without prior notice.

1. Data confidentiality

Accessing the website www.hotel-eshop.ro implies users' acceptance that their personal data will be stored and processed by SC MOD-ELLE COMPANY SRL, a company registered in the register of personal data processing operators under number 21873.

The purpose of processing this data is to create a database for preparing marketing reports and sending information about promotions organized by MOD-ELLE COMPANY or about activities carried out by MOD-ELLE COMPANY through any means of communication (mail, email, telephone, SMS, etc.).

MOD-ELLE COMPANY undertakes not to disclose personal data to third parties, except for the direct marketing operator (the E-send service is currently used). Your personal data may be transmitted to the competent authorities for the purpose of verifying commercial transactions or to other authorized authorities for any necessary checks, if this is requested in accordance with the legislation in force.

MOD-ELLE COMPANY certifies that it will respect the rights conferred by Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, Law no. 365/2002 on electronic commerce, as well as Ordinance no. 130/2000 on consumer protection when concluding and performing distance contracts, as subsequently amended and supplemented.

2. Copyright

The entire content of the website www.hotel-eshop.ro, consisting of images of bed linen, duvets, hypoallergenic pillows, mattress protectors, bedding sets, bedspreads, white towels, bath mats, white bathrobes, tablecloths, and images of any other products presented on the website, texts (home textiles and hotel textiles), graphic elements, symbols, web graphics, scripts, programs, and other data are the property of MOD-ELLE COMPANY SRL and are protected by copyright and intellectual and industrial property legislation.

The use, without the written consent of MOD-ELLE COMPANY SRL, of any of the elements listed above is punishable under the applicable legislation.

3. Access to Information on the Website

MOD-ELLE COMPANY guarantees all users access, for personal purposes, to the website www.hotel-eshop.ro.

MOD-ELLE COMPANY does not grant users the right to download, modify the website, in whole or in part, reproduce it, in whole or in part, copy it, sell/resell it, or exploit it in any other way for commercial purposes or in ways contrary to the interests of MOD-ELLE COMPANY, without its prior written consent.

4. Fraud

Any attempt to access another user's personal data or modify the content of the MOD-ELLE COMPANY website, as well as any attempt to influence the performance of the server hosting the website www.hotel-eshop.ro, will be considered a fraudulent action against the MOD-ELLE COMPANY website and will result in MOD-ELLE COMPANY SRL initiating civil and criminal legal proceedings against the person or persons responsible.

5. Limitation of Liability for Products and Services

Products and services are offered subject to availability. Consequently, MOD-ELLE COMPANY cannot guarantee that all products presented at a given time will be in stock.

The images published on the website are for illustrative purposes, and the delivered products may sometimes differ from the images shown in terms of color shades, accessories, appearance, and other aspects due to monitor settings, etc.

MOD-ELLE COMPANY reserves the right to modify the technical specifications of its products without prior notice.

MOD-ELLE COMPANY is responsible for any defects in products purchased through its own sales network. MOD-ELLE COMPANY is fully responsible for replacing or repairing products that have material or manufacturing defects. Only products in new and unused condition will be replaced or returned.

If the customer does not opt to replace the product, or if delivery of the product is impossible or incorrect, the maximum amount of compensation that MOD-ELLE COMPANY may pay is equal to the amount collected by MOD-ELLE COMPANY from that customer.

6. Limitation of liability for prices

The prices shown do not include VAT (at the rate established by the applicable legislation in force) or delivery costs.

7. Limitation of liability for delivery

The products are delivered within a maximum of 4 business days from order confirmation, by GLS courier.

• Orders placed Monday through Friday by 4:00 p.m. are shipped within the following two days, depending on product availability in stock.
• Orders placed over the weekend will be processed and shipped to customers on the next business day of the following week.

Delivery is free for orders over 999 lei, only within the GLS courier’s coverage area.

Product delivery covers the entire country and can therefore be carried out anywhere in Romania. In addition to the price charged by MOD-ELLE COMPANY for products or services, the customer will be required to pay a delivery fee directly to the courier company transporting the products for orders under 999 lei and for localities outside the GLS courier’s coverage area.

The products are delivered by the courier company with which MOD-ELLE COMPANY has entered into a collaboration agreement. The applicable rates are those specified in the “ORDER AND PAYMENT” section of the www.hotel-eshop.ro website.

MOD-ELLE COMPANY cannot be held responsible for delays or cancellations in the delivery of ordered products if these are caused by circumstances beyond MOD-ELLE COMPANY’s control, including: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances, or other cases of force majeure, in accordance with the applicable Romanian legislation in force at the time the order is confirmed.

If the customer cannot be found at the specified address during the mutually agreed time period, the product(s) subject to delivery will be handed over to the customer only after reconfirming the order with a sales consultant and paying any additional costs incurred as a result of this situation.

8. Limitation of liability for payment

Payment for products ordered under this Customer Agreement may be made in advance by postal money order, online payment, bank transfer, or cash deposit into MOD-ELLE COMPANY's account at one of the Alpha Bank branches, or cash on delivery upon receipt of the products.

MOD-ELLE COMPANY reserves the right, in certain cases, to request advance payment for the products. Proof of payment of the advance or of the invoice value for delivery of the products must be sent to MOD-ELLE COMPANY at the email address vanzari@hotel-eshop.ro.

Delivery will take place only after payment has been confirmed by MOD-ELLE COMPANY's bank.

Online payment by card, by selecting the online payment processor in the order form, is also considered an advance payment. In this case, MOD-ELLE COMPANY will ask the electronic payment processor to confirm the security and validity of the transaction and will also carry out additional checks, if necessary, before delivering the products.

The ordered products must be paid for in full; otherwise, delivery will not be carried out.

9. Limitation of liability for product warranties

The warranty provided by MOD-ELLE COMPANY for the bed linens it manufactures and sells is 36 months.

Products purchased through this website are covered by the warranty specific to the relevant product categories, guaranteeing compliance with their technical, dimensional, and quality characteristics, as well as the quality of manufacturing operations, in accordance with the applicable legislation.

The Customer is required to carefully study the maintenance instructions on the product label and on the labels affixed directly to each component of the product, in order to avoid improper maintenance of the products and deterioration of their qualities.

MOD-ELLE COMPANY is not responsible for any loss of product quality resulting from failure to comply with the maintenance and usage instructions mentioned above.

10. Limitation of liability for links to other websites, servers, and browsers

The website www.hotel-eshop.ro, owned by MOD-ELLE COMPANY, is hosted on servers belonging to third parties, whether individuals or legal entities, with the right to use the server space and related services acquired in accordance with the law.

MOD-ELLE COMPANY cannot be held responsible for any errors that may occur on the website, regardless of the reasons for their occurrence, including website changes, settings, or updates.

MOD-ELLE COMPANY cannot be held responsible for errors that may occur as a result of using certain browsers to access the MOD-ELLE COMPANY website.

MOD-ELLE COMPANY is not responsible for the content, quality, or nature of websites that can be accessed through links on the MOD-ELLE COMPANY website. The owners of those websites bear full responsibility for them.

MOD-ELLE COMPANY assumes responsibility toward its customers for making every effort necessary to limit or interrupt access to websites that, by the nature of the information published, contravene Romanian legislation, but it cannot be held responsible for violations of the law committed by those websites.

11. Terms and conditions for returning Hotel-eshop products

If a customer wishes to return a product that falls under one of the situations presented below, they are required to notify the online store www.hotel-eshop.ro in advance, in writing, by email at vanzari@hotel-eshop.ro.

A customer of the online store www.hotel-eshop.ro may request the return of products in the following situations:

• If the product does not match the specifications presented on the website. If the ordered product does not match the specifications presented on the website, the customer may request its return for replacement or a refund of its value. If replacement with a higher-value product is agreed, the customer will pay the difference. If the value of the replacement product is lower, the customer will receive a partial refund up to the value of the replacement product.
• If the customer wishes to cancel the purchase, they may do so within 15 calendar days. According to Government Ordinance 34/2014 on the legal framework for distance contracts, a consumer may cancel the purchase (by unilaterally terminating the contract) within 15 calendar days of receiving the product ordered remotely.
• For any other reason and without having to justify it, the customer may request the return of the products for replacement or a refund of their value. If replacement with a higher-value product is agreed, the customer shall pay the difference. If the value of the replacement product is lower, the customer shall receive a partial refund up to the value of the replacement product.
• Products must be returned at the customer's expense within 15 calendar days of receipt.

The consumer may not unilaterally terminate the following types of contracts, unless the parties have agreed otherwise:

a) contracts for the supply of products or services whose price depends on fluctuations in financial-market rates that cannot be controlled by the trader;

b) contracts for the supply of products made according to the consumer's specifications or distinctly personalized products, as well as products that, by their nature, cannot be returned or that may rapidly deteriorate or spoil;

c) contracts for the supply of audio or video recordings or computer programs, where these have been unsealed by the consumer.

Other categories of products that cannot be returned:

If the returned products fall into one of the situations below:

• Products that are not in their intact original packaging or are missing the original accessories that accompanied the product;
• Products that are not in the same condition in which they were delivered, namely new and unused (in the original packaging, with all labels intact and the accompanying documents);
• Products that are not returned within 15 calendar days of receipt;

Mod-Elle Company SRL, as the administrator of the online store www.hotel-eshop.ro, considers the return invalid and shall be entitled to refuse to refund the amount.

LEGAL REGULATIONS regarding product returns

1. Definition of the consumer

In accordance with Government Ordinance 34/2014, a consumer is any natural person or group of natural persons formed into associations, as defined in Article 2, point 2 of Government Ordinance No. 21/1992 on consumer protection, republished, as subsequently amended and supplemented.

Therefore, legal-entity customers are not entitled to return purchased products.

2. Transportation costs

The products must be returned at the customer's expense within a maximum of 15 calendar days of receiving the products.

3. Payment deadline for the returned order

SC Mod-Elle Company SRL will refund the value of the ordered products within 10 days of receiving the returned product/products.

The refund will be made using the same payment methods reasonably used (in the case of cash on delivery, the refund will be made by bank transfer to the account provided by the consumer).

For orders paid by card, the amount will be refunded to the same card used for the transaction within 3–30 days of accepting the return.

4. Condition of the returned product

The returned product must be in the same condition in which it was delivered, namely new and unused (in the original packaging, with all accessories, intact labels, and accompanying documents).

These provisions apply in accordance with OG 34/2014 when purchasing products through this website using distance communication techniques.

Repeated cancellation of a purchase may be considered abusive, and we reserve the right to refuse to accept the return.

12. Disputes and final provisions

Any other issue caused by the products and services presented on www.hotel-eshop.ro or by the information presented on this website, which is not already regulated by an article of this document, shall be resolved amicably within 30 business days from the date on which the user provides written notification of the issues.

If the conflict cannot be resolved amicably, jurisdiction shall lie with the courts of Romania, within the jurisdiction of the Municipality of Bucharest.

The Client assumes all such risks when agreeing to this document “TERMS AND CONDITIONS”.

Consent may be expressed either expressly, through its unequivocal communication, by any means, to the representatives of MOD-ELLE COMPANY, or tacitly, by purchasing one or more products.
